{"id":3375,"date":"2021-09-17T09:49:24","date_gmt":"2021-09-17T09:49:24","guid":{"rendered":"http:\/\/www.businessconsultantmilan.it\/?p=3375"},"modified":"2024-07-01T10:14:43","modified_gmt":"2024-07-01T08:14:43","slug":"mandatory-mediation","status":"publish","type":"post","link":"https:\/\/www.businessconsultantmilan.it\/en\/mandatory-mediation\/","title":{"rendered":"MANDATORY MEDIATION"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The <\/span><b>mandatory mediation<\/b><span style=\"font-weight: 400;\">, introduced by Legislative Decree No. 28 of March 4th 2010, represents the activity of an impartial third party who assists two or more parties to reach an amicable agreement aimed at settling a dispute and formulating a proposal of settlement.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Since March 2011 those who undertake a legal action must, therefore, previously undergo a conciliation and arbitration procedure.<\/span><\/p>\n<h2><b>MANDATORY MEDIATION<\/b><span style=\"font-weight: 400;\"> CASES<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The <\/span><b>mandatory mediation<\/b><span style=\"font-weight: 400;\"> it is envisaged for several specific cases:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Condominium disputes;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For real rights: property, usufruct, easement, etc.;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For hereditary division and successions;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In family agreements;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For lease or loan contracts;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For Business rents;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For claims of damages from: circulation of vehicles and boats, medical liability, defamation by press or other advertising means;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For insurance, bank and financial contracts.<\/span><\/li>\n<\/ul>\n<h3><b>DURATION OF THE MEDIATION<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The <\/span><b>mandatory mediation process<\/b><span style=\"font-weight: 400;\"> must have a duration no longer than 3 months.
