ALTERNATIVE DISPUTE RESOLUTION: WHAT DOES IT MEAN?

The Alternative Dispute Resolution (ADR) defines all those activities and procedures aimed at resolving disputes between companies and individuals or between companies, on contracts for the sale of goods or services, in a short time and without resorting to judicial proceedings.

The legislator in Italy has introduced this procedure (Legislative Decree No.130) on the 6th of August 2015, implementing the consumer ADR directive 2013/11/UE.

“Consumers and companies thus have the opportunity to resolve any national or cross-border disputes regarding sales contracts or the provision of services through a complaint (an ADR procedure) by an ADR entity supervised by a competent authority” according to the definition of the Mas stated by the Ministry of Economic Development (MISE).  

RESOLUTION OF THE DISPUTES: HOW DOES IT WORK?

Through the Alternative Dispute Resolution in Italy, a dialogue is established between the parties, in which each of the interested parties sets out its own point of view on the dispute and relies on the mediation/conciliation of the ADR body. Due to its specific expertise, the ADR body will find a fair solution in a short period of time.
