In a dispute of any nature – civil, commercial or corporate – the best and most correct solution to get out of it for the parties involved is to start a mediation procedure. In fact, a fair and shared solution can be reached without having to resort to costly judicial procedures.
The Alternative Dispute Resolution (ADR) is a solid conciliation procedure with excellent results, which resolves issues between companies or between companies and consumers, or even between workers and companies. The mediation procedure is governed by law in order to ensure a clear and streamlined path.
HOW TO SUBMIT A MEDIATION APPLICATION?
The first step in starting the conciliation procedure is the filing of a mediation request. The mediation application must be submitted to an accredited mediation body – a public or private entity registered in the appropriate register – located in the place of the Judge territorially competent for the dispute.
The application must contain the indication:
- of the Body
- of the parties
- the object of the claim
- the underlying reasons
In practice, the filing of the application involves the statement of the will to find a meeting point for resolving the dispute, relying on the professional mediation of an impartial person.
Once the request has been received, the Body sets the date of the first meeting, which must take place within 30 days from its application, and designs the mediator.
At this point the application and the date of the first meeting are communicated to the other party. The summoned party must communicate, within 7 days of receiving the communication, whether or not he intends to participate in the first meeting and, therefore, start the mediation.
